How Payday Loans Work in Iowa

Iowa legally calls a payday-style advance a delayed-deposit service. These services take a check or draft from the customer and hold it until the agreed time of collection. Though the state statute describes this process through a payment instrument, this service still extends short-term credit to customers.

A customer cannot have more than two outstanding checks at the same time. The total amount of all checks cannot exceed $500. This limit is for all checks combined and is not a $500 limit for every licensee. Each licensee can hold a check for a maximum of 31 days.

Iowa's Tiered Fee Limit

Maximum processing fees for paper checks are $15 for the first $100 of the check amount, and $10 for each additional $100 of the check amount. This includes the processing fee for a partial $100 check amount. Thus, for a $500 check the maximum fee would be $55. If the fee is taken from the check amount before releasing the funds to the customer, then the customer would be paid less than the check amount, however they would still be obligated to pay the check amount in full.

Before completing a transaction, the licensee must disclose the fee, the APR required by federal law, the date a check can be presented, and the penalty for a returned payment. In some cases, a short term may cause an APR to look much larger than the percentage fee, so compare the dollar cost, amount received, amount due and payment date together. Refinancing and Additional Charges

An Iowa licensee cannot use the proceeds from another delayed deposit transaction to pay off, refinance, or consolidate their own transaction. Businesses under common ownership or control are restricted from this practice as well. Iowa does not have a provision in its statutes for a regular fee-based rollover provision.

According to the statute for delayed deposits, the licensee cannot levy additional charges. The licensee may charge one penalty for $15 when a check or an authorized payment clears as unpaid. When that penalty is invoked, this is the licensee's only remedy for a returned check, as stipulated in this law.

Payment Method and Records

A licensee cannot require repayment in a way that causes the customer to pay additional fees to the lender or a related business by requiring the customer to purchase another payment product. Carefully review each ACH authorization for the date of the withdrawal and the amount, and keep the agreement and all payment records.

Determine if the full payment is able to leave your account at the time of the loan repayment date and still cover expenses for rent, food, utilities, transportation, and medicine. If paying the loan causes you to miss any of these bills, another loan will likely leave your money situation even worse.

Before giving a company your banking information or your identity, check Iowa Division of Banking's license-verification system. Check the written terms against the terms advertised. Consider a demand for an upfront processing or release payment by gift card, wire transfer or cryptocurrency to be a red flag for a scam.
