Missouri Payday Loan Laws and Protections

A consumer guide to Missouri's $500 limit, short loan terms, total charge ceiling, cancellation right, and renewal rules.

How Payday Loans Work in Missouri

In Missouri, a payday advance is considered short-term unsecured credit. The maximum a borrower may receive is $500. A lender must obtain a license from the finance agency if it wants to provide payday advances and is not a member of the exempt institution groups.

The contract stipulations of Missouri do not allow for an immediate demand for debt repayment. The payoff date must stay at least 14 days after origination and no later than 31 days. This timing stipulation is also applicable to a renewed contract.

Missouri's Total Charge Limit

This debt has a single overall cap on the finance charge throughout its life. The charge can be estimated from the beginning period and all subsequent extensions. The total combined amount of these charges cannot exceed 75% of cash initially provided. This is not a standard fee for every $100 borrowed.

Since both the timing and size of charges influence the annual percentage rate, the actual agreement should show the dollar finance charge, total payment, and APR together. Have the lender indicate the total amount due if the loan is renewed.

Cancellation and Early Repayment

A borrower can cancel the deal for free during a short time period. They have to return the entire advance before the lending location completes its first full workday after the deal. A return can be documented with a dated receipt.

Paying the final settlement of the balance before its due date may alter the final price. Therefore, for the exact amount to be paid on the specific date, contact the provider. Do not depend on the amount previously stated.

Renewals and Ability to Repay

Up to six additional loan periods can be granted. Each request must be made in writing. The customer must also pay any outstanding financing costs and pay down the first advance by 5%. The company must grant the additional loan period after these steps are completed.

The business must evaluate if the proposed scheduling and amounts are reasonable for the customer. This assessment does not answer the question of whether it is within the customer's means. A customer must set aside funds for the means of procuring housing, food, services, travel, and healthcare.

Before Borrowing in Missouri

Do not provide personal or bank information until you have confirmed the lender is licensed. Review the privacy notice and payment authorization. Your payment should leave you with your basic needs covered. Never give an upfront loan payment by gift card, wire transfer, or cryptocurrency.
