Wisconsin Payday Loan Laws, Costs and Protections

The full-debt cap, the cost before and after maturity, and the deadlines for cancellation and repayment plans.

Which Wisconsin loans fall under the payday rules?

Wisconsin law allows payday lending with a license. To determine what rules apply, consider the loan term and the method of collection. The payday loan laws apply to loans with a term no longer than 90 days, when the lender either holds a post-dated check to collect payment or makes an agreement with the borrower for the later withdrawal of funds through a pre-authorized bank account withdrawal. It is the collection method, and not the interest rate, which determines whether a loan meets the payday definition. An installment loan with a longer term may be governed by a different law.

This guide examines Wisconsin's law governing nonbank payday loans found in Wisconsin Statute 138.14. The section provides exemptions for banks and credit unions, as well as certain licensed earned wage access providers. Protections for payday loans provided by this law should not be extended to assume protection of other small loans or paycheck advances.

A covered lender needs Wisconsin authorization even if it operates online or out-of-state. See the Department of Financial Institutions (DFI) web page for payday lenders for the official process to the NMLS Consumer Access. An active payday lender license for Wisconsin is searchable under the legal name listed on the contract. A loan company license is a different license type. Contact the DFI if the record does not align with the business offering the loan.

Count interest and charges toward the borrowing limit

The total payday loan principal and all interest and fees owed to licensed lenders must stay within the smaller of $1,500 and 35% of the borrower’s gross monthly income. Gross income refers to the borrower’s total income before any payroll or other deductions. The total of the principal plus interest and any fees or charges must be included in the calculation. This is not intended to be a $1,500 cash advance with interest added.

Example: work out the room for a new loan's total repayment
What to countIllustrative amount
Gross monthly income$3,000
Income-based ceiling$3,000 × 35% = $1,050, which is below $1,500
Existing payday debt, including its charges$250
Room under the combined ceiling$1,050 - $250 = $800 total principal and charges for the new loan

A cash advance quote offering $700 cash and charging $140 in interest means that the total obligation would be $840. With a $250 debt, the total debt would be $1,090, which would exceed this borrower’s ceiling of $1,050 by $40. Although the cash advance may seem small, the full obligation may not fit.

Wisconsin no longer operates a state-run payday loan database according to the latest DFI guidelines. Lenders must check their own records, and you will be required to provide a statement about your other payday loan borrowing. Changing payday loan lenders does not reset the limit. Payday loan lenders cannot charge you a separate fee for an eligibility check. The legal limit does not determine what your household can afford, nor does it mean that you will be approved.

Price the original loan from its written disclosure

Wisconsin’s payday statute places no cap on how much interest can be charged prior to the original due date. Because of this, the dollar cost stated is extremely important. The example charge on this page was an assumption and is neither a state authorized charge nor a charge on a payday loan that is currently being offered.

A borrower who qualifies for our separate hypothetical example could receive $700 and repay $840 in one payment in 14 days. The estimated APR is 521% as calculated as ($140 ÷ $700) × (365 ÷ 14) × 100. The examples assume the full $700 is received and do not account for the costs associated with failed payment. The annual calculation provides a way to compare prices across different loan periods. In this example, the payment amount is still $840.

Prior to the transaction, the lender will disclose the dollar borrowing cost and the APR, assuming you repay on schedule. The disclosures must explain cancellation, repayment-plan rights and the potential failed-payment charge. Use these disclosures to evaluate the cost of the cash you are about to receive and the amount the lender will collect. Also ask about any other fee charged for the application, for the lender to access its database, or for cashing the lender’s proceeds check; the payday rules do not authorize these fees.

Cancel promptly or ask for an early payoff

You may cancel your loan without a fee by giving back the advance to your lender before the business closes on its following business day. If a lender operates around the clock, you must return the advance before 5 p.m. on that following business day. Make sure you send the funds back as quickly as possible on your lender’s operating days. Do not assume that a day is a business day for your lender.

Partial payments and early payments are permitted after the cancellation window. There is no prepayment penalty. You have a right to a refund for unearned interest for full early repayment. You may request a payoff to reflect this. This should be kept with your proof of payment. Partial payments do not cancel the remaining balance. They do not also change the due date of the remaining balance.

After the due date, separate a repayment plan from refinancing

If a payday loan has an unpaid balance when it matures, the lender must offer four equally sized installments. These are to be spaced around your paydays. There is an exception to this requirement if any payday lender licensed in your state offered a repayment plan to you in the last 12 months. This is the case even if you refused the repayment plan. Changing payday lenders does not remove this exception.

Consider two dates on the repayment-plan offer. Under Wisconsin payday lending admin rules, the lender must send its offer no later than 10 days after maturity. If a check or electronic payment is submitted within that time, and it is still clearing, the lender must send its offer once it learns that payment failed. Your acceptance is required to reach the lender no later than 10 days after the day it delivered the offer by hand, sent it by mail or emailed it. Count from that sending or delivery date, not from the date you read the offer.

Obtain an agreement signed by both you and the lender that states the balance, payment amount and due dates of each installment. The first payment cannot be due before the payday that occurs after the lender makes the offer. Any income that is not paid regularly, e.g. irregular/variable, is presumed to be paid over a two-week period. If no pay documents are available, the rule assumes payment is made on a monthly basis.

Consult DFI before signing on to a repayment plan. Two official sources give different answers. The January 2026 DFI consumer guide gives an example of a repayment-plan interest calculation. The statute states that a lender can charge up to 2.75% per month after the due date, calculated on a daily basis at one-thirtieth of the monthly rate, with no interest charged on that added interest. However, DFI-Bkg 75.07(1)(a) states that the contract notice must disclose that there will be no interest while a consumer participates in the plan. Send DFI your signed notice and proposed plan in order to have the interest quoted by the plan reviewed. Because of the conflicting documents, it is best not to assume every plan is interest-free, and every quoted interest is allowed.

Refinancing is a different kind of transaction. You may use a new payday loan to repay the first one only once. You cannot fund the repayment of that replacement loan with a new payday loan. Using a different lender or an affiliated business does not get around this as well. The definition says a new loan taken within 24 hours of fully repaying the previous payday loan counts as a subsequent payday loan.

Consider payday loan alternatives before using your allowed payday loan refinance, especially if there are options to postpone or alter payments on the original bill. A new loan can still incur costs of borrowing, even if it closes the previous account.

Track payment attempts and take disputes to DFI

A lender can submit your check to collect payment only once. For an electronic withdrawal, each authorization allows only one attempt; that authorization does not allow repeated attempts. A lender may charge up to $15 for an unpaid check or a denied transfer. Your bank may assess its own charges to your account. Check to see if a charge came from the lender or your bank.

Payday lenders are not permitted to charge any type of generic or normal late payment or default fees. Court awarded costs and interest post judgment are different. Payday lenders are allowed to collect through a civil lawsuit, but cannot garnish wages nor use threats of criminal prosecution for nonpayment. The protection given to payday loans should not be transferred to different loan products without reviewing their rules.

For a charge you don't understand, missing plan offer or withdrawal dispute, send the lender your description of the problem in writing. If this is not resolved to your satisfaction, the DFI website describes the process for filing a complaint and provides forms for your use. If you wish DFI to look into the matter, you must provide your agreements and offers and acceptance dates. You should also provide your bank records and receipts, if any. DFI can look into matters within its jurisdiction, but cannot represent you or act as your attorney, nor can it act as your court. DFI will not look into matters being litigated. Reply separately to any court order or deadline.
