A consumer guide to Idaho's income-based loan limit, licensing, disclosures, renewals, extended payment plans, and repayment risks.
Yes. Payday loans are legal and regulated under Idaho law as part of the Idaho Credit Code. Any business providing payday loans to residents of Idaho is required to obtain a Regulated Payday Lender License from the Idaho Department of Finance.
This includes online businesses. Lenders that do not have a physical presence in Idaho still have to be licensed to lend to Idaho residents. Borrowers have the option of confirming the licensing of the payday loan company before accepting the offer. The advantages and protections of state laws are only available to licensed lenders.
Laws in Idaho have guidelines on what licensed payday lenders can offer and how the loan has to be processed.
| Idaho Rule | What It Means |
|---|---|
| Maximum loan amount | The lesser of $1,000 or 25% of a borrower's gross monthly income |
| Written agreement | The loan must be documented in a signed agreement by the borrower |
| Fee and APR disclosure | The agreement must disclose the total fees in dollars and as an APR |
| Renewal limit | A lender may renew a single payday loan a maximum of three times in a row |
| Extended payment plan | A borrower may request one payment plan in a 12-month period |
The $1,000 amount is a maximum amount. Not every borrower will receive a loan up to that amount. The loan amount can be lower depending on the borrower's monthly income and is determined by the lender's evaluation and other loan repayment terms.
Idaho has not established a statewide limit for the fee charged for a payday loan by a licensed lender. This means that payday loan costs can vary by lender.
The written agreement must show the principal amount, the total dollar amount of the fees, and the annual percentage rate. It should also state the total amount due and the payment date.
Payday loans have high APRs because the fees are calculated for a loan that is paid back in a very short time. Always look at the total amount that must be repaid, rather than just the amount you are borrowing or the fee that is being charged for every $100.
Before accepting a loan offer, consider the following:
In Idaho, a payday loan can only be renewed a total of three times in a row by a licensed lender. After the third renewal, the entire loan amount must be paid before the lender is allowed to perform any transaction related to the loan.
Each time a loan is renewed, the lender may charge a renewal fee and leave the original principal amount unpaid. This may potentially increase the total amount the borrower has to pay. Before agreeing to any loan, be sure to check if a renewal option is included and how much the renewal option will cost.
A payday loan lender cannot require a borrower to take another payday loan from their company in order to complete the current loan transaction.
Idaho law allows payday loan borrowers to request a single extended payment plan with each lender every twelve months.
The request must be made, and a written payment plan must be available no later than the due date of the loan. The plan must provide:
The lender is not permitted to charge a fee to the borrower for the plan. If a borrower believes that they will be unable to make a scheduled payment, they should contact the lender prior to the due date.
Before sharing identity, income, or bank-account information, confirm the company holds an Idaho payday-lender license. Read its privacy notice and the complete agreement, including the APR, total fees, total due, due date, electronic-payment authorization, renewal terms, and payment-plan rights.
Under the Idaho Credit Code, payday lenders are licensed and regulated by the Idaho Department of Finance. The Department also has the authority to perform examinations, investigate complaints and pursue enforcement actions against payday lenders to ensure compliance with state laws.
